1071 Coalition Presentation

The first meeting of the 1071 Coalition was at the beginning of December. I've attached it as it contained a lot of useful stats and data:

The Lake Lanier Association has just come out with its feedback on the Supreme Court's Lake Lanier decision. Basically their message is "don't worry". The decision was expected and doesn't change much. Here's the full text:

"Earlier this week the US Supreme Court made a decision as to whether the court would hear the appeal of a case concerning water storage in Lake Lanier.

Our attorney, Clyde Morris, who is representing us in the Tri-States litigation, has provided the following information about this decision and its relevance to Lake Lanier.

U.S. SUPREME COURT'S DENIAL OF CERTIORARI IN GEORGIA vs FLORIDA

In this case, the Corps, Georgia, the Atlanta area water supply providers, and the Southeastern Federal Power Customers (SeFPC)  entered into a settlement agreement in a lawsuit filed by the SeFPC to obtain compensation for power generation that was allegedly being foregone due to management of LakeLanier for water supply purposes.  Florida and Alabama intervened and challenged the agreement.  The primary issue in the case was whether the settlement agreement should be upheld. The DC District Court ruled that it would, but later the DC Circuit Court of Appeals reversed and said it would not.  Georgia appealed the Circuit Court's ruling to the Supreme Court.

On January 12, 2009, the US Supreme Court denied certiorari in the case, meaning that it refused to entertain Georgia's appeal.  There was a very small chance that the Supreme Court would accept the appeal, because only a very small percentage of cases appealed to the Supreme Court are accepted and those that are must present questions that the Court deems worthy of its review.  So, the Court's decision not to allow the appeal is of little surprise to anyone.  The question is: what, if any, affect will the Supreme Court's decision NOT to hear the appeal have on us?

The immediate effect is that there is no change in the status quo in the Water Rights litigation.  While it could have been beneficial if the Supreme Court had granted the appeal, we would have benefited only if the Court had ruled in Georgia's favor on the merits of the case.  Since that avenue is now moot, we will simply continue with the Water Rights litigation already going on in Florida, according to the schedule already established by that Court.

It is important to understand that it was primarily dicta (language in the DC Circuit Court's ruling that isn't authoritative) that has given rise to Florida's and Alabama's now-famous argument that water supply is not an authorized purpose of LakeLanier.  I expect Judge Magnuson to include a ruling regarding that argument as part of our litigation.  That issue will be addressed in Phase 1, while the claims of primary importance to the LLA - regarding the Corp's draw-down of water in the Lake - will be addressed later, in Phase 2."

Sailing on Lake Lanier

Lake Lanier has a variety of Sailing Clubs, each tailored to meet your different needs and desires. Whether your main goal is to socialize and make friends, or to race regionally or nationally, follow the links below to find the club for you:sailing2.jpg

Lake Lanier Sailing Club

Located in Flowery Branch, Lake Lanier Sailing Club is a private, family oriented sailing club that is involved in all aspects related to the sport, but places special emphasis on sailboat racing. They are affiliated with the US Sailing Association, South Atlantic Yacht Racing Association, and Dixie Inland Yacht Racing Association. They have a large clubhouse, campground, beach, bathing facilities, an 88 boat marina, and dry storage facilities that accommodate mroe than 200 trailered boats. Club members compete in numerous one-design portsmouth dinghy and auxiliary fleets at local, regional, and national levels. They also have a very active junior fleet.

Heart of Sailing

Heart of Sailing is a charity that he founded in 2004 to provide opportunities for children with developmental disabilities to sail and get active on the water.

A national charity, it is run by local volunteers from Bald Ridge Marina. Sailboats take children and their families out onto the lake for an hour at a time. Children are encouraged to get involved by steering the boat, helping with the ropes and most of all, getting wet and enjoying being on the water.

Trips are planned almost every weekend from May through October. The boats sail hourly with up to 5 children on board and every participant was rewarded with a medal and a certificate of completion.

The Heart of Sailing focuses on children with developmental disabilities. If the child can follow instructions, keep themselves and others safe and demonstrate a basic understanding of their responsibilities, they are eligible to participate.

You can find out more by visiting their website at http://heartofsailing.org/regional29.asp or calling Bill Schindler at (678) 794-5863. The group is also looking for adult volunteers, both experienced sailors and novice helpers, to make the sailing events run smoothly.

Barefoot Sailing Club

This club has been in existance for over 30 years. It is different from the others because you don't have to own a boat to join, you only need a love for sailing.

Catalina 22 Fleet 58

Fleet 58 is a member of the Catalina 22 National Sailing Association. As a part of this association, it is recognized across the nation as being one of the most active fleets for cruising, racing, and social events. They believe the most valuable benefit of Fleet 58 is the members. Membership fees are $35 a year.

Southern Sailing Club of Lake Lanier

Their mission is to provide an exciting, affordable, and family-oriented club that actively seeks to enrich the sailing experiences of its members with programs that support safety, seamanship, and performance. They offer two membership levels: full and associate. Full membership is for members with or without a boat and costs $50 a year. Associate membership costs $25 a year and is for members without a boat who would like to be a part of SSC tradition.

University Yacht Club

This club was founded in 1951, is a member of the United States Sailing Association, and is listed on the registery of Yachting Clubs in America. Members participate in active power and sailing fleets that are berthed at Club docks. As the name suggests, applicants must have attended an accredited college or university, and must be sponsored by three UYC members in good standing. Upon approval of membership, there is an initial membership fee in addition to annual membership fees.

Kingdom Yachts Sailing Club

Based in Cumming, Kingdom Yachts Sailing Club has members across the south and cruise worldwide.

After two down years, this has been a great week for Lake Lanier.

  • Prize money: $2.5 million
  • Sponsors: BP and Castrol

  • Location: Laurel Park's new mega-ramp

There will be large accompanying shows at the Georgia World Congress Center and Georgia Dome.

Sonny Perdue announced the news in Atlanta today:

“The Forrest Wood Cup is the largest fishing tournament in the country, and bringing this tournament to Georgia is exactly what I envisioned for the mega-ramps we are building as part of Go Fish. This tournament will provide nationally televised exposure for our fishing resources, generate excitement about fishing in Georgia and provide a positive economic impact on our local communities."

2009 Polar Bear Swim is Great Success

The 12th Annual Polar Bear Swim is another Lake Lanier Canoe and Kayak Club success story.

83 jumpers registered to jump in chilly Lake Lanier.

Elizabeth Canupp dressed up as a Christmas tree and won the best costume category; awards were also given out for best jump, and the oldest and youngest swimmer.

Jumpers only needed to stay in the water for several seconds - enough time to enter and get out - but that was enough. Many took advantage of nearby hot-tubs to warm up again.

You can see photos of the event here.
